Sales Promotion Schemes

A sales promotion scheme is a popular marketing technique used when an advertiser offers the chance to go in to the draw to win something after purchasing their product or service. An example of a sales promotion scheme is when a customer buys a magazine, they fill out an entry form and go straight into the draw to win a holiday.

Some basic requirements of a sale and promotion scheme include the pricing not exceeding the usual retail price, the date on which the winner of the promotion will be determined is clear and the winner is determined at least partly by chance.

Sales promotion schemes need to comply with the Advertising Codes of Practice as well as the Gambling Act 2003. This Department of Internal Affairs (DIA) Fact Sheet details the relevant interpretation of the legislation which should be considered.

For ongoing information about gambling advertising, the DIA produces Gambits, a newsletter providing information on recent work and significant issues in the gambling sector. It is aimed at gaming machine societies, site operators, sector organisations and the community in general, to increase understanding of and compliance with the law.
