Media Release: ASA announces further consultation on draft Children’s Advertising Code and draft Food and Beverage Advertising Code

3 April 2023

The Advertising Standards Authority (ASA) has today released its draft Children’s Advertising Code and draft Food and Beverage Advertising Code for consultation.

These draft Codes have been developed by the ASA Codes Committee following a review of the submissions received in the initial consultation on the Children and Young People’s Advertising Code. The submissions provided valuable feedback on key issues and as a result, two separate draft Codes have been released for consultation.

The Children’s Advertising Code will replace the Children and Young People’s Advertising Code and will apply to all advertising targeted to Children aged under 16 years.

The new Food and Beverage Advertising Code will apply to all food and beverage advertising including advertising to Children and includes a restriction preventing targeting Children under 16 years with occasional food or beverage advertisements.

ASA Chief Executive, Hilary Souter, said “The development of a food and beverage code means all rules relating to food and beverage advertising can be grouped together in a specialist code and recognises the breadth of this advertising category.

The Children’s Advertising Code sets standards for advertising to children under the age of 16. The Food and Beverage Advertising Code outlines principles and guidelines for this category and includes the requirement for a high standard of social responsibility when advertising to all those over the age of 16 years.”

The ASA Codes Committee invites consumers, public health, the media and advertising industries, and other organisations and individuals to engage with this second consultation and provide their feedback on all aspects of the two draft Codes.

The consultation period runs from 3 April to 1 May 2023. Submitters are invited to review the consultation document and provide their feedback. The Codes Committee will use these submissions to inform their development of the final Codes, for release later in 2023.
